BULAWAYO — A 22-year-old Hope Fountain man, Mertzo Mupande, has been handed a suspended prison sentence following a bizarre and predatory early-morning incident where he allegedly stormed a private residence to demand sexual favors in exchange for cash.
The court, presided over by Magistrate Barbra Phiri, heard a harrowing account of the events that transpired at the home of 44-year-old Virginia Nkomazana. According to prosecutor Mehluli Ndlovu, Mupande gained entry into the yard using an alternative entrance at approximately 3:00 AM. Once inside, the accused reportedly targeted Nkomazana’s bedroom door, shouting demands for her to emerge. In a desperate attempt to lure the victim outside, Mupande began flashing US dollars, starting with a US$10 offer. When met with silence, he increased the "bid" to US$20, eventually escalating to US$80 as the victim remained barricaded inside, fearing for her safety.
The standoff lasted for an hour until the landlord arrived with police officers at 4:00 AM. Upon realizing the authorities had been alerted, Mupande attempted to evade arrest by hiding in the kitchen, but was quickly apprehended.
Mupande pleaded guilty to criminal trespass. While the nature of the intrusion caused significant distress to the victim, the court opted for a lenient sentence:
Verdict: Four months in prison.
Condition: The sentence was wholly suspended for five years on the condition of good behavior.
While Mupande was charged with trespass, legal experts note that such cases often skirt the boundaries of more severe harassment laws.
"This case highlights the vulnerability of women in their own homes," says human rights lawyer Abigail Ncube. "While a trespass charge was successfully prosecuted, the predatory nature of offering money for sex under duress borders on attempted sexual assault or harassment under the Criminal Law Code."
The lenient suspended sentence has sparked some debate on social media regarding the safety of women and whether such "minor" charges adequately deter gender-based intrusions.
